Short answer is that I don't know. I also see that it is in the public interest that drivers be alert enough to drive the vehicle safely. However, all that is happening now is that drivers with apnea re driving w/o any treatment whatsoever because they are afraid of taking chances.

Rules vary from jurisdiction to jurisdiction. The simple fear and uncertainty alone is enough for drivers to turn down an opportunity to get treated. For many, driving an 18 wheel truck is all they have. They cannot afford to take a risk.
