Thank you BreathingEZ for your reply; I am currently looking to see if I have a case since I am not yet officially diagnosed with anything, going through all the tests-except for the narcolepsy which my current sleep specialists left me with the impression that could have been a misdiagnosis. But nothing is for sure yet. I have found out, however, it seems they have been planning on discharging me for awhile. I found this out by accident, I was on the computer looking for employment when I found my position posted on one of the employment websites-dated 1/16/09. It's ironic how I made my medical issues known to them in December, and my testing dates and medical appointments started increasing 3-4 weeks before they posted my position. Which by the way, they posted it 1/16/09 but did not terminate me until 2/26/09. Possibly because they figured they needed to 'build' a case against me? Like I said earlier, up until my termination day, I had never been warned in writing by anyone; I was never made aware in the four years that I worked for them that my job performance was anything less of acceptable or in question. As far as being verbally warned, we had a morning meeting daily-we would discuss during that time things that needed to be done or followed up on, all I would get addressed to me would be in the manner of 'you need to do this/that', but everyone in the meeting would have the same said to them with whatever duties they were required to do, or asked to do. Actually it was the contrary, they would praise my work and initiative; and I have actually received raises although not eligible (annually) due to my job performance. So, it leaves little doubt in my mind that I was terminated due to my ongoing medical issues. But how do I fight it? I don't have any 'proof' or documents to prove anything. Again, thank you for your feedback. It is very much appreciated.
