I have been fighting with my employer for about a year now. I luckily have a union but unluckily they suck. I have finally payed for a lawyer and there attitude has changed.

Under the EEOC amendment of 2008 sleep disorders are specifically named as a qualifying disability. You can request a reasonable accommodation with proper medical documentation they must give you the accommodation. Now that said they will dick with you over what is "proper" documentation and make your life hell but a lawyer will put a stop to that and you should file a charge of discrimination with the EEOC. Also about anytime you mention that your having a problem related to work and a medical problem that is a request for RA. Check out the EEOC's web site.

Now i am not a lawyer and this isn't legal advise so contact the EEOC and a local lawyer specializing in disability or employment law.
