Insurance denying MMA surgery?

AHI of 21 complex apnea. Failing CPAP, ASV and dental appliance. One ENT recommended not removing tonsils but rather trying MMA surgery or dental appliance. In light of failing the dental appliance I went to an oral surgeon familiar with MMA. Her office started the wheels rolling for the surgery. A couple days ago they came back saying "the surgery is not necessary but rather cosmetic and that there is a lack of information on whether the surgery is effective for sleep apnea. I thought it was fairly well documented that it as the MOST effective surgery. They are going to appeal. However I am wondering if a medical malpractice lawyer might be a good preemptive measure to right a letter saying his is representing me in this matter.

Anybody have any experience on this?
