The biggest loophole for an employer is that, to the best of my knowledge, ADA only covers firms with more than 15 employees. I get the impression your company has more since you referred to someone as "upper management."

There is also a clause about whether your disabilitiy constitutes a "major impairment."

But I'm concerned, no, shocked, that any company would take the actions you state because of sleep apnea, although what you describe sounds more like narcolepsy. And I'm completely confused as to why the doctor didn't ask that the company assign you temporarily to a different position: "reasonable accommodation" under the ADA. What I don't want to sound rude, but have you given us all of the facts? If you have, this should chill all of us to the bone, but this really sounds like something else is going on.
