taxi, bus, friend, etc..etc..
There is never an excuse to be driving if you think it dangerous given your state at that time. remember everyone else on the road.
If untreated OSA clouds peoples cognitive abilities to the point that they are making these decisions then I am all for the testing. If anything it may force people to get treatment.
