The biggest problem with being diagnosed with sleep apnea may be having to prove that you didn't fall asleep at the wheel if you are involved in any accident. A normal driver, if he fell to sleep while driving, would have to admit to it, otherwise he couldn't be charged.

This presents a problem as there is no way to prove that you are not sleepy or that you are after the fact. A quandry for public policy especially if there are really as many people as is suspected that are affected by sleep apnea.
