I went to several malpractice attorneys without positive result, after the same physician failed to first diagnose or suggest consultation for a first degree relative of mine then me. I was actually becoming psychotic on her combination of three psychotropic medications while , of course becoming hypoxic at night. They don't think its malpractice that they can successfully pursue in the courts, even though I'm a doctor and I think it is malpractice. Basically, they said that in Texas it is too hard to sue a physician. If you have tangible injury , for example, you are paralyzed and in a wheel chair, then they can get a verdict for your case.
I , as a physician, believe that the medical profession will not take it seriously until there is a big malpractice case.
I take issue with the statements that it is an HMO issue. It is ignorant physicians of all areas of medicine who participate in managed and unmanaged care.
