Problem is, insomnia as a root cause of a person's tiredness and inability to perform on the job is difficult to establish.
Suppose, for instance, that I stay up to all hours of the night watching TV, reading, or whatever. I show up at work really dragging. My performance suffers, and the bosses notice.
What would cause me to claim insomnia as the reason, especially if it is covered under ADA? No one is at my house observing me, so why not make the claim?
I am in no way making light of the problem. I know only too well the problems it causes. But I also know the potential for abuses in the workplace, having witnessed first hand how many people unfortunately "game" the system these days.
