legitimately depressed!

I don't have that many bad nights of insomnia anymore. My worst days are 5 hours sleep usually on nights that I have anxiety about one thing or another. On those nights, I fall asleep well but wake up early 3 or 4 a.m.

I had a few nights of insomnia in a row recently and felt pretty depressed the days following.

Here's my concern: My husband and I just began marriage counseling. We went to one appointment jointly and then we were to go the next time solo. When I went to my solo appointment, after that bout of insomnia, I began to get teary eyed when discussing certain subjects. I know I am depressed right now due to unemployment, father has cancer, marital problems and the insomnia greatly adds to it. BUT, I was diagnosed by this marriage counselor (P.H.D.) as having clinical depression! Maybe this is a strange question, but can't you be legitimately depressed without being diagnosed this way? Can't depression be a natural state due to the circumstances in your life and the fact that you are not getting enough sleep? Seeing this diagnosis of depression on paper just didn't seem right to me. Does anyone know what I'm trying to say?

What if my marriage doesn't work out and it comes down to a custody battle...and the judge finds out I am diagnosed with depression. I spend a lot of happy quality time with my children and my husband is the "grump". This diagnosis doesn't sit right with me...
