Posted by johnelb... on May 17, 2001 at 11:49:53:a little over a week ago, i was fired from a job that i've had for the last 10 years. i had recvd employee of the month award several years ago, and have always had good evaluations, etc.
i have narcolepsy, and used to be on ritalin. i'd still fall asleep at work. my supervisor pulled me into human resources, and the human resource person told me that they don't pay me to sleep on the job. she told me that i needed to either find a new job, or go to my doctor and change my medication. i went to my dr, and he changed my medication to provigil 200 mg.
now i can't sleep at nights. usually am wide awake until about 2:00 in the morning. at that time, i needed to be at work by 6:30 in the morning. so began being tardy to work, falling asleep at work, and not being able to sleep at night.
when i was written up for my tardies, i explained that it was because of the provigil, that i had narcolepsy, etc. I've continued to mention that in every meeting. they didn't really seem to care.
my supervisor changed my hours to 8:00-4:30, only because i was able to show that there wasn't any work to be done from 6:30 to 8:00.
after being fired, i talked with human resources about my narcolepsy, the ADA, etc. They said that they are supposed to give reasonable accommadation, but that i'm still supposed to fulfill the job requirements, etc. and that one of those requirements is being on time. where i was working, being on time really wasn't that important of an issue, being 15 minutes late or so would not have hurt anything.
do i have any rights about this? i had even heard once that my employer was wrong in telling me to change my medication.
also, i've come to find out that other people were tardy at my work more than i was. i was tardy 5 times in a 7 week period, and i've had co-workers tell me since that they've been late 2-3 times a week, if not more, and have never been reprimanded...
