Tired Man--Sutton ADA case

Posted by sleepykitty on August 06, 2002 at 20:41:19:

Tired Man,
The Sutton case you referred to below... Is that Sutton vs United Air? About twins who wanted to be airline pilots but had very poor eyesight but were able to correct it to 20/20 w/ glasses? So they got the job because they had been discriminated as a person w/ a disability. And they are using that to say that a PWN on meds is no longer regarded as disabled????? As if taking meds makes you perfect (which is what 20/20 is considered)? That you no longer still have EDS or C or any other symptoms of N as long as you take your pills?

I just realized what case you may be referring to because I am looking for case law that proves N is a disability. Seems there are some in Indiana who don't believe it. And they happen to be involved in my case of discrimination. I can't find anywhere where it says it isn't. Find some places (such as ADA and Job Acccom Network) where they say it is. And see where depression is generally regareded as being a disability. I'm not depressed (yet!) but the symptoms are the same as what I experience except I won't ever be well, or get over N (short of a cure), nor in my case can it be treated w/ meds. And a person who has only depression does not have the intermittent episodes of REM that invade our lives in various forms.

Kitty
